Stone asks Davis about the new superseding indictment filed by Special Counsel Jack Smith. Davis points out that the new charges are virtually identical to the previous set of charges filed against President Trump – the major difference being that based on the recent Supreme Court ruling on presidential immunity, some individual counts were dropped entirely.

Davis points out that following the filing of these motions, any decision by Judge Tanya Chutkan would presumably be challenged by the president to the Appeals Court, and if the Appeals Court did not rule for Trump, it will ultimately go the U.S. Supreme Court – meaning a trial could not take place for at least another year. "What's the hurry, other than election interference?" Davis asks Stone.

In light of Davis' comments, Stone says the purpose of the filing was obvious: to generate negative publicity against Trump, to blunt the momentum Trump has gotten from the surprise endorsements of RFK Jr. and Tulsi Gabbard, and to distract from Kamala Harris' failure to expose herself in any meaningful way in press conferences or one-on-one interviews.
